Until very recently New York was one of a very small number of states that did not offer its citizens a “no-fault’ divorce option where “irreconcilable differences” may be cited as grounds for the divorce. Grounds for divorce in New York were:
- Abandonment – for a year or more
- Adultery
- Cruel and inhuman treatment
- Living separate and apart for one or more years pursuant to the provisions of a Separation Agreement between the parties.
Governor Patterson recently signed into law a “no-fault” divorce law in New York which will, at least as far as grounds are concerned, make the divorce process a bit easier on New Yorkers. Despite the new law, many issues related to divorce still must be addressed such as:
- Division of marital property (property acquired by the couple during the marriage)
- Division of debts
- Child support
- Child Custody
- Maintenance (alimony)
