Divorce

Divorce is a very difficult process, but an experienced, compassionate and thoughtful attorney can protect your interests and work to minimize the conflict.  Attorney Steve Buitron has guided many clients in the Upstate area through divorce and began them on a road to a new beginning. 

Until very recently New York was one of a very small number of states that did not offer its citizens a “no-fault’ divorce option where “irreconcilable differences” may be cited as grounds for the divorce.  Grounds for divorce in New York were:

  • Abandonment – for a year or more
  • Adultery
  • Cruel and inhuman treatment
  • Living separate and apart for one or more years pursuant to the provisions of a Separation Agreement between the parties.
Governor Patterson recently signed into law a “no-fault” divorce law in New York which will, at least as far as grounds are concerned, make the divorce process a bit easier on New Yorkers.  Despite the new law, many issues related to divorce still must be addressed such as:
  • Division of marital property (property acquired by the couple during the marriage)
  • Division of debts
  • Child support
  • Child Custody
  • Maintenance (alimony)
